Learning outcomes
The course has an institutional nature and aims to make the student achieve the basic systematic knowledge in relation to the judicial protection of rights and the use of the civil process as a tool for the implementation of such protection. Starting from the examination of the general principles of the subject, the analysis moves to the process of cognition, in its various articulations, and then to the executive protection and the so-called special procedures.
The main objective of the course is to confront the student with the complexity of the civil procedural system, in its various articulations and forms of protection, without adopting a notionistic approach but problematic and aimed at enhancing the role of the process as a "tool".

Si raccomanda di acquistare un codice di procedura civile aggiornato, strumento fondamentale per chi voglia seguire le lezioni. Si consiglia, al riguardo, il Codice di procedura civile curato da F. Carpi e C. Gamba, Bologna University Press, 2023, con testo a fronte pre e post-riforma Cartabia del processo civile.
Gli studenti che devono integrare le attività di diritto processuale civile, avendo sostenuto l'esame di Diritto processuale generale nel corso di laurea triennale di Operatore giuridico di impresa ovvero quello di Tutele Giurisdizionali nel corso di laurea G.I.P.A., o l'esame equivalente nel corso di Consulente del Lavoro Unibo, si prepareranno su:

Teaching methods
The course offers students the opportunity to draft short written opinions and to engage in written argumentation of the legal issues covered in the program, also in preparation for the final exam.
In the course of the lectures, therefore, exercises on the topics covered will take place.
In parallel with the lectures, there will also be one or more in-person exercises, lasting about 2 hours, consisting in the concise illustration of a topic by the lecturer and in the administration to the students of the text of an opinion, which they will have to provide following the indications previously set out (within the time limits and according to the extent indicated by the person in charge of the exercise), finally in the self-correction by the students following a description by the lecturer of the optimal manner and content of carrying out the written response, leaving space for students to ask questions, elaborate, request verification on any errors made.

Assessment methods
he final examination consists of a written test at the end of the course.
The end-of-course exam aims to verify the achievement of the teaching objectives and the learning of the subject being examined, namely civil procedural law. Civil Code and Code of Civil Procedure (not annotated) allowed.
The written test will consist of:
Part I) 11 multiple choice questions (each right question is worth one point, no penalties for wrong answers): duration 25 minutes. No use of codes allowed
Part II) 2 open-ended questions (up to 5 points for each question): duration 70 minutes. Use of civil code and code of civil procedure (not annotated) permitted
part III) solution of a practical case in the form of an opinion (up to 10 points): duration 90 minutes. Admitted the use of civil code and code of civil procedure (uncommented).
The student who achieves a score:
- equal to or less than 15: will have to retake the test;
- of 16 or 17: will be allowed to take an oral test, with one question (up to a maximum of two extra points);
- from 18 and above: (without prejudice to the possibility of refusing the grade and taking the test again) the student may accept the grade or take an oral test (two questions, up to two points for each question).
Any oral test will be held in the afternoon of the same day as the written paper.

Final dissertation: there is no waiting list for the granting of the dissertation. The title is decided together with the professor.
