Learning outcomes

The course is aimed at illustrating principles, rules, legal theories and case law representing, as a whole, the regulation of consumer's protection, as the weakest part of the consumer relationship.

Course contents

The course is divided into five parts.

The first part is focused on the parties of the consumer relationship: who is “the professional”, who is “the consumer”. The starting point is UE law, source of the definitions. Some European Court of Justice's fundamental decisions are taken into account, with reference to specific matters.

The second part is aimed at considering the consumer relationship. The main concept; the reason why is better to refer to consumer relationship rather than to consumer contract; the essential steps of the consumer relation's regulation.

The third part is aimed at considering consumer protection in some areas: the area of unlawful provisions; the general field of the frame regulation of illegal business practices.

The fourth part is aimed at considering the area of consumer protection in contracts concluded out of the place of business and distance sales.

The fifth part is aimed at considering consumer protection in relation to some specific products or services (touristic sales, time-sharing, financial services, consumer credit).

2. Only for students who effectively attend the course, selected cases of law (i.e., EU Court of Justice's or Italian Supreme Court's judgements) discussed in class during the course. These students can omit the part of the book above mentioned that will be indicated by professor Zorzi during the course.

Teaching methods

Traditional lectures, electronics devides and tools, teaching exercises, debate on relevant cases of law, especially with regard to judgments and decision of the EU Court of Justice and/or the Italian Competition and Market Supervisory Authority (antitrust).

Assessment methods

Oral examination.

For students who attend (frequent) class will be arranged special examinations (to evaluate with the teacher)
