Public law of federalism and economic subsidiarity

Introduction to the course.

Economic Constitution: definitions and matters; the  impact of EU policies; competion and market; economic Constitution and relationship between state, region and local authorities

Financial Constitution, definitions and matters; the  impact of EU policies; constraints on public finance; financial Constitution and relationship between state, region and local authorities

the principle of subsidiarity in UE and Italian regulation.

Annual schedule of public finance.

Stability Law and budget law. Constraints derived from EU.  fiscal compact

The role of state and other local autorities in economic system, through implementation of the principle of vertical subsidiarity.

Criteria for allocating of public spending at local level.

The role of private actors in economy through implementation of the principle of horizontal subsidiarity.

Fiscal Federalism At. 119 Cost. and its implementation. Local authorities and its functions. Functions Allocation according to the principle of subsiadiarity. In particular: basic functions. The financing of the functions of regional and local authorities.
The limits to the financial autonomy of regions and local authorities: budget constraints, constraints arising from the stability pact will. Exceptions.
The consequences on the organization of local authorities. Controls.

Teaching methods

In addition to basic notion, we're going to study matters interested by recent reforms. We use text of laws, decisions. Students will works in groups. Then we'll discuss together.

Assessment methods

Students  attended lessons: the procedures will be agreed during the lessons. Verification try to ensure the successful acquisition of the principles and tools of public law.

Students  non-attended lessons: the final exams will be oral.

To attend the exam, each student must sign up via AlmaEsami within the deadline. Those who cannot sign up must immediately (before the official closing of the subscription lists) communicate the problem to the teaching secretariat. Deciding whether to allow not enrolled students to attend the exam or not is up to the teacher.

The teacher will minute the final mark on the date set and indicated in Almaesami.
