The aim of the course is to give a complete survey of the juridical and judicial landscape of the Italian and European systems in the topic of public procurement and contract.
Contenuti
1. Contents of the course
Explanation of Public Procurement judicial regulation and structure: principles, conceptual basis, rules, moving from the most important European directives and from new Public procurement code.
Lectures contents:
- Introduction;
- The Traditional Approach to Regulating Public Contracts in Italy. The Impact of European Law;
- Principal Sources. The Allocation of Legislative Power between State and Regions;
- Focus: from the “Italian Authority for the Supervision of Public Contracts for works, services and supplies” to the “National Anti-Corruption Authority”;
- General Principles. Thresholds. Mixed Procurement;
- Procedures (Choice of);
- Open Procedures;
- Restricted Procedures;
- Use of the Negotiated Procedure with or without Prior public call publication;
- Competitive Dialogue;
- Exercise (sentences of EU Court of Justice);
- Award temporary definitive - Exercise (sentences of EU Court of Justice);
- Focus: Requirements;
- Focus: Project Financing;
- Focus: “Subcontracting” - the Contract of “Avvalimento”;
- Focus: Green Public Procurement;
- Focus: Architectural and Engineering Services;
- Stipulation of the Contract;
- Procurement by Entities operating in the Water, Energy, Transport and Postal Services Sectors and Repealing (see Directive no. 25/2014). Concession Contracts (see Directive no. 23/2014);

2. Assessment methods
Some lectures will combine theoretical exposition with pratical work, presentation, discussion, and also comment and discussion of texts.
3. General objectives of the course:
Develop critical thinking and judjement making. Develop research and analytical skills. Develop collecting and analysing information skills.
4. Specific objectives:
Gain knowledge in describing and analysing assessing Public Procurement (EU and Italian law)
Knowing, through various cases-law, the difficulties of formulation, implementation and development of Public Procurement law.
5. The exact plan of the lectures will be loaded in September, after the pubblication of Public Procurement monography.
