Course contents
"Comparison involves history": this sentence of an oustanding scholar of Comparative law tellingly summarizes the method of this course, named “historical-comparative” method, which combines the history with tha comparative method in order to find out the common foundations of current European private laws. Following this perspective the historical knowledge could be a critical tool to verify the current conceptual frame of private law in Europe. Also, it constitutes an important and useful key to understand identities and differences whether amid civil law systems or regarding common law system. Upon completion of the course, students will be able to: -Understand the significant role that Roman law have had in the civilian tradition -Be aware of “historicity” of the common foundations of European laws -Understand the differences and the identities of legal rules amid different European legal systems in the light of the historical perspective

Teaching methods
The course is organized through 3 lectures per week, according to the timetable and the calendar published at the beginning of the semester. During the lessons the teacher will use didactic material that will be specifically indicated or made available on line Some lectures of the course will be held by important scholar
Assessment methods
The exam will take place in written and oral form and will aim to test the critical assimilation of the contents of the program
The evaluation of the test will be carried out taking into consideration
- the knowledge of the course contents
- the ability to make connections between the different parts of the program
- the ability to develop critical arguments
- the articulation and accuracy of the exposure
By way of example, the following criteria will be used to assess the final mark (that will be out of 30/30):
- sufficient or barely sufficient knowledge on the programme, limited reasoning ability, some difficulties in using technical and legal language → 18-21/30;
- fairly good knowledge of the programme, adequate critical reasoning ability, sound use of technical and legal language → 22-25/30;
- comprehensive knowledge of the programme, notable reasoning ability, good command of technical and legal language → 26-29/30;
- extensive knowledge of the programme, very good reasoning ability, and ability to fully master technical-legal language → 30-30L/30.
