Course contents
The seminar will have a practical and methodological focus. The Topical Method of Roman Jurists The lectures are designed to provide essential methodological concepts that are useful for addressing private law cases, in close connection with the teachings of institutional courses. This will involve referring to the Roman jurisprudential method and the methodological tools used by classical Roman jurists. Key topics will include the forms of legal argumentation, the role of legal definitions, and the 'rhetorical' methods used in analyzing specific cases. Procedural Clinic and Roman Case Studies The main emphasis will be on analyzing private law cases, primarily based on Roman sources. The lectures will be conducted in a workshop format, with students working in groups and alongside the teacher to frame and solve practical cases. Efforts will be made, wherever possible, to link the acquired methodology to contemporary legal practice.
For the preparation of the examination it will be sufficient to refer to the lecture notes. The teacher will indicate any optional further reading in class.
