Learning outcomes
The series of seminars aims to analyze the complex phenomenon of health protection within the framework of the activities carried out by the Parliamentary Commission of Inquiry into environmental, agri-food and related offenses in the waste cycle management activities (Law May 10, 2023, no. 53). In this particular context - on the basis of an interlocution with the aforementioned Commission - a systematic reconstruction will be carried out of the complex regulatory fabric made up of domestic law disciplines and harmonized European Union law norms that, although they concern extremely differentiated areas (food safety and quality, wholesomeness of water intended for human use, waste cycle management), are linked by the purpose of ensuring the preservation of a healthy environment and the achievement of high levels of personal health protection. In order to preside over the effective achievement of these goals, analysis of the multiple private enforcement tools aimed at making the objectives outlined by the legislature effective is of fundamental importance.
Course contents
The seminar - also making use of the input provided by the Parliamentary Commission of Inquiry into environmental, agri-food and related offences in the waste cycle management activities (Law May 10, 2023, no. 53) - aims to offer a comprehensive overview with respect to the disciplines that, as a whole, are functional in ensuring the healthiness and quality of food, the purity of water intended for human use and, in more general terms, the integrity of the environment with respect to threats from waste disposal (toxic substances, plastics, batteries, photovoltaic plants), especially where these present peculiar characteristics from which dangers of contamination may arise, even in the long term. With this in mind, the focus will be on private enforcement tools that - working in synergy with preventive disciplines - make it possible to ensure high levels of protection of the health and integrity of the environment even in a long-term perspective, in line with current paradigms of sustainable development and the increased attention to safeguarding the rights of future generations.
