Learning outcomes

The course aims to provide students with the essential tools to understand the fundamental principles and the major legal concepts of environmental law. Special attention will be paid to its practical application too.

Course contents

Course contents for students of the degree programme First cycle degree programme (L) in Business and Public Administration Consultant (9 CFU) and for students of the degree programme Single cycle degree programme (LMCU) in Law (7 CFU), with the distinction below indicated:

1. Fundamental principles of environmental law
2. Legal sources of environmental law: international law, European Union law, national law (State law and Regional law)
3. Environmental protection in the Italian Constitution
4. Public authorities and environmental protection: the role of the State, Regions and local authorities
5. Air pollution
6. Noise pollution
7. Electromagnetic pollution
8. Water pollution
9. Soil protection and the waters regime
10. Waste management
11. The control of industrial major accidents regulations
12. Energy and the environment
13. Nature protection: nature parks and nature reserves
14. Landscape heritage
15. The right of public access to environmental information and the transparency in environmental matters
16. Integrated environmental procedures: Strategic Environmental Assessment, Environmental Impact Assessment, Integrated Environmental Authorization, Environmental Single Authorization
17. Local public services of environmental importance
18. Environmental damage and protection measures
19. Economic instruments in environment public policies

For the students of the degree programme Single cycle degree programme (LMCU) in Law (7 CFU), the corse contents do not include the topics of the points 17, 18 and 19.

In order to achieve an appropriate competence, it is important the knowledge of the following acts:

- Italian Constitution;

- General Law on administrative procedure (Law 4 agosto 1990, n. 241);

- Environmental Code (Legislative Decree April 2, 2006, n. 152);

The current version of the above texts is available in the online teaching materials, below indicated.

Teaching methods

Teaching will take place throughout lectures, especially via confrontation and debate with the students, who are invited to participate actively during classes and make proposals for expanding and deepening the discussion. Students may be given additional questions and/or issues to examine outside the lectures during the office hours indicated in the bottom of the page. The Professor will be available to discuss related matters with the students at the end of each lesson.

To provide maximum information and coordination during lectures, students are encouraged to always check the website of the teacher as well as any information concerning the course.

Assessment methods

The final exam is oral. The interview will focus on the topics in the section "Course contents".

The evaluation will take into consideration:

• knowledge of institutional profiles;

• knowledge of case law and legal doctrine;

• connections between different parts of the program;

• debate skills;

• speaking ability;

• speaking accuracy.

Enrollment in the final exam can only be made on-line via the University web site.

During the examination, attending students will be granted the opportunity to present a topic of their choice.

 

Prequalification

The exam can be taken only after passing the examinations in constitutional law and private law.

Teaching tools

To make more complete study and investigation of the issues discussed during lectures and seminars students shall indicate additional teaching materials, in addition to the texts specified above.

Office hours

Professor Pellizzer is available to receive students at the end of each lesson as well as on Monday at 12.00 at Dipartimento di Giurisprudenza - Campus di Ravenna, via Oberdan, n. 1.
